This website (waleadeyemi.com) is operated by MOVE IN SILENCE LTD, a company registered in England and Wales under company number 16330581, with its registered office at 1st Floor Spitalfields House, Stirling Way, Borehamwood, WD6 2FX, United Kingdom. “Walé Adeyemi” is a trading name of MOVE IN SILENCE LTD. Throughout the site, the terms “we”, “us” and “our” refer to MOVE IN SILENCE LTD.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these terms and conditions (“Terms of Service”, “Terms”), including any additional terms, conditions and policies referenced here or available by hyperlink. These Terms apply to all users of the site, including browsers, customers and contributors of content.
Please read these Terms carefully before accessing or using our website. If you do not agree to these Terms, you should not access the website or use our services.
Any new features or tools added to the store are also subject to these Terms. We may update, change or replace any part of these Terms by posting updates to this page. Your continued use of the website following any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.
YOUR STATUTORY RIGHTS
Nothing in these Terms affects your legal rights as a consumer under UK law, including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where anything in these Terms conflicts with your statutory rights, your statutory rights prevail. For advice about your rights you can contact Citizens Advice.
SECTION 1 – ONLINE STORE TERMS
By agreeing to these Terms, you confirm that you are at least 18 years of age, or that you are the legal guardian of, and consent to the use of this site by, any minor dependents using it.
You may not use our products or the Service for any illegal or unauthorised purpose, nor may you violate any laws in your jurisdiction (including copyright laws). You must not transmit any worms, viruses or any code of a destructive nature. A breach of any of these Terms may result in termination of your access to the Service.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone where we have a legitimate reason to do so.
You understand that your content (not including payment card information) may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to conform to technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission.
Headings are for convenience only and do not limit or affect these Terms.
SECTION 3 – ORDERS AND CONTRACT FORMATION
When you place an order, you will receive an order confirmation email. This acknowledges receipt of your order; a contract between us is formed when we dispatch your order. We may decline or cancel an order before dispatch — for example, where a product is unavailable, where there is a pricing or product description error, or where we suspect fraud. If we cancel your order after payment, we will refund you in full.
We may limit or cancel quantities purchased per person, per household or per order, including orders that appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases.
SECTION 4 – PRICES AND PRODUCT INFORMATION
All prices are shown in pounds sterling (GBP) and include VAT where applicable. Delivery charges are shown separately at checkout before you confirm your order. Prices for our products may change, but changes will not affect orders we have already accepted.
We have made every effort to display the colours and images of our products as accurately as possible, but we cannot guarantee that your screen’s display of any colour will be accurate.
Occasionally information on our site may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions or availability. We reserve the right to correct any errors and to cancel orders affected by obvious errors (with a full refund if you have already paid).
None of this affects your statutory right to receive goods that match their description.
SECTION 5 – RIGHT TO CANCEL (CONSUMER CONTRACTS REGULATIONS 2013)
If you are a consumer in the UK, you have the right to cancel your order for any reason within 14 days of the day you (or someone you nominate) receive the goods, without giving any reason.
To exercise this right, tell us by email at info@waleadeyemi.com before the 14-day period expires, stating your order number and that you wish to cancel. You then have a further 14 days to return the goods to us. You are responsible for the cost of returning the goods unless they are faulty or not as described.
We will refund the price of the goods plus standard delivery charges (we are not required to refund the extra cost of any premium delivery option you chose) within 14 days of receiving the goods back, or of you providing proof of postage, whichever is earlier. Refunds go to your original payment method.
You may inspect the goods as you would in a shop, but if you handle them beyond what is necessary to establish their nature, characteristics and functioning, we may reduce your refund to reflect any diminished value.
Exceptions: the cancellation right does not apply to goods made to your specification or clearly personalised (bespoke and made-to-order items), or to sealed goods which are not suitable for return for hygiene reasons once unsealed.
This cancellation right is in addition to, and does not affect, our voluntary Returns Policy or your statutory rights in relation to faulty goods.
SECTION 6 – FAULTY GOODS (CONSUMER RIGHTS ACT 2015)
Under the Consumer Rights Act 2015, the goods we supply must be of satisfactory quality, fit for purpose and as described. If they are not:
• within 30 days of delivery, you are entitled to reject the goods and receive a full refund;
• after 30 days, you are entitled to a repair or replacement; if that is not possible or fails, you are entitled to a refund. If a fault appears within six months of delivery, it is presumed to have been present at delivery unless we can show otherwise;
• these rights apply regardless of any conditions in our Returns Policy.
If you receive a faulty, damaged or incorrect item, please contact us at info@waleadeyemi.com as soon as possible so we can put it right. We will cover return postage for faulty or incorrect items.
SECTION 7 – RETURNS AND EXCHANGES
Details of our voluntary returns and exchange process are set out in our Returns Policy. Our Returns Policy operates alongside - and never restricts - your rights under Sections 5 and 6 above.
SECTION 8 – OPTIONAL TOOLS AND THIRD-PARTY LINKS
We may provide access to third-party tools over which we have no control. We provide access to such tools “as is” and “as available” without warranties of any kind, and we have no liability arising from your use of optional third-party tools.
Certain content, products and services available via our Service may include materials from third parties, and links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for the content or accuracy of third-party materials or websites. Please review the third party’s own policies before engaging in any transaction with them. Complaints or questions regarding third-party products should be directed to the third party. This section does not exclude any liability we have to you under UK law.
SECTION 9 – USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If you send us creative ideas, suggestions, proposals, plans or other materials, whether at our request (e.g. contest entries) or otherwise (collectively, “comments”), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments you forward to us. We are under no obligation to (1) maintain any comments in confidence; (2) pay compensation for any comments; or (3) respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine is unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable, or that violates any party’s intellectual property or these Terms.
You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary rights, and will not contain libellous, unlawful, abusive or obscene material or any malware. You may not use a false email address or pretend to be someone other than yourself. You are solely responsible for any comments you make and their accuracy.
SECTION 10 – PERSONAL INFORMATION
Your submission of personal information through the store is governed by our Privacy Policy.
SECTION 11 – PROHIBITED USES
In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any laws or regulations; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
SECTION 12 – INTELLECTUAL PROPERTY
All content on this site — including designs, graphics, logos, images, text and the “By Walé Adeyemi” and “B-Side” names and marks — is owned by or licensed to us and is protected by intellectual property laws. You may not use it without our prior written permission.
SECTION 13 – LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory rights as a consumer (including under the Consumer Rights Act 2015); or any other liability that cannot be excluded or limited under UK law.
Subject to the above, we are not liable for: losses that were not foreseeable when the contract was made; losses not caused by our breach; or business losses (including lost profits, lost revenue or business interruption), as this site is intended for consumer use.
We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error-free, and we may withdraw or suspend the Service from time to time.
SECTION 14 – INDEMNIFICATION
If you use the Service in breach of these Terms or in violation of any law or the rights of a third party, you agree to compensate us for any losses, claims or demands (including reasonable legal fees) made by any third party that arise from your breach or violation.
SECTION 15 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed. Such determination shall not affect the validity and enforceability of the remaining provisions.
SECTION 16 – TERMINATION
These Terms are effective unless and until terminated by either you or us. You may stop using our Services at any time. We may terminate this agreement if you fail to comply with any of these Terms, and you will remain liable for all amounts due up to and including the date of termination. Obligations and liabilities incurred prior to termination survive termination.
SECTION 17 – ENTIRE AGREEMENT
Any failure by us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms and any policies posted by us on this site constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
SECTION 18 – GOVERNING LAW
These Terms, and any separate agreements whereby we provide you Services, are governed by the laws of England and Wales. If you are a consumer, you may bring proceedings in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts of your home nation, and you will benefit from any mandatory consumer protections of the law of the country where you live.
